User discretion is advised: The advice and actions of agents created using SimTheory are the responsibility of the user. If you choose to follow the advice of an agent and it impacts you, SimTheory is not liable. Always use your own judgment and discretion.

Ownership and liability: You own all rights to the agents you create and the content they generate using SimTheory. This means you are responsible for them and their actions.

Be responsible: Don't use SimTheory to create AI that promotes hate speech, discrimination, or harm to individuals or groups.

Respect privacy: Don't use SimTheory to invade others' privacy or collect data without explicit consent.

Don't break the law: don't use SimTheory for illegal activities. If you're unsure, it's probably a no-go.

Be ethical: Don't use SimTheory to create deceptive or misleading AI.

Respect intellectual property: Don't use SimTheory to infringe on others' copyrights or patents.

SimTheory Terms of Use

Introduction

Welcome to SimTheory. Please read these Terms of Use carefully before using the SimTheory website or services (the "Service") operated by SimTheory PTY LTD.
By accessing or using the Service, you agree to abide by these Terms at all times. If you disagree with any part of the terms, then you may not access the Service.

User discretion

The advice and actions produced by AI agents created using SimTheory are the sole responsibility of the user who created the agent. SimTheory is not responsible for any repercussions arising from following advice or actions proposed by these agents. Users are advised to exercise their own judgment and discretion.

Responsibility

Users are responsible for the agents they create using SimTheory. Any agent promoting hate speech, discrimination, or harm to individuals or groups is strictly prohibited. Users must not use SimTheory to invade others' privacy or collect data without explicit consent.

Legal compliance

Users must not use SimTheory for illegal activities. If you're unsure whether an activity is legal, it's probably a no-go. Users must comply with all applicable laws, rules, and regulations in their use of the service.

Ethics

Users must not use SimTheory to create deceptive or misleading AI. We expect our users to act ethically and responsibly when using our service.

Intellectual Property

Users must respect the intellectual property rights of others. Don't use SimTheory to infringe on others' copyrights or patents.

Agents and generated content

For any agent ("Agent") that you create and files you upload using SimTheory, you retain all rights in that Agent (and to the extent you create derivative works, you own all rights you otherwise would own in them) and any text, images or video it generates ("Generated Content") that are elicited directly or indirectly by you.
You grant to SimTheory Pty Ltd and to any SimTheory user who elicits Generated Content from your Agent to the fullest extent permitted under the law a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify and otherwise use the Agent you created and any related Generated Content for any purpose in any form, medium or technology now known or later developed.
As to a user interacting with an Agent created or uploaded by another user or created or uploaded by SimTheory Pty Ltd, the user who elicits the Generated Content from an Agent owns all rights in those Generated Content and grants to both SimTheory Pty Ltd and the creator(s) of the applicable Agent a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify and otherwise use any Generated Content.
For avoidance of doubt, violations of SimTheory's Acceptable Use Policy unrelated to intellectual property issues does not affect the user's intellectual property rights in any Agents or their Generated Content.

Termination

SimTheory reserves the right to terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Limitation of liability

It is expressly understood and agreed that SimTheoryshall not be held accountable for any indirect, incidental, special, consequential, or exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data or other intangible losses (even if SimTheory has been informed of the potential for such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (I) the utilization or the inability to utilize the Services or any related information; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party (including users) on the Services; or (iv) any other matter relating to the Services. Under no circumstances will SimTheory Pty Ltd’s total liability to you for all damages, losses or causes of action exceed one hundred dollars ($100). Certain jurisdictions do not permit the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Consequently, some of the above limitations set forth above may not apply to you. If you are dissatisfied with any portion of the site or with these terms of use, your sole and exclusive remedy is to discontinue use of the Services.

Indemnification

You agree to defend, indemnify and hold harmless SimTheory and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the service, by you or any person using your account and password; b) a breach of these Terms.

Governing law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Changes to terms of use

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
We will notify you of changes, but aren't liable if you don't see the notification.
